This motion argues that the lawsuit, which stems from Lively’s complaint to the California Civil Rights Department regarding her treatment during and after the filming of *It Ends With Us*, lacks merit.

According to Judge Liman, the NYT has presented “substantial grounds” suggesting that their dismissal motion may likely succeed. This is a significant hurdle for Baldoni, who argues that the discovery process will not be overly burdensome. Yet, the judge countered that the complexity of the issues at hand and the sensitivity of the requested documents could create a more complicated discovery process than Baldoni’s team anticipates.

As the legal wheels turn, the judge reassured that the NYT did not delay in filing its motion, having done so within 21 days of being served, and intends to address the motion promptly. Meanwhile, Baldoni’s team may find solace in the fact that the court has allowed them to pursue discovery against other parties involved. However, depositions are unlikely to begin anytime soon, ensuring that this legal drama drags on, much to the chagrin of those hoping for a swift resolution.

A spokesperson for The New York Times commented on the situation, emphasizing the First Amendment implications and asserting that Baldoni’s lawsuit is an unwarranted attempt to undermine their reporting. The NYT has stood firm, insisting that they acted responsibly by informing the public of Lively’s complaints. This latest twist adds yet another layer to an already complex case that has been brewing since Lively’s initial complaint was filed on December 20, 2024.
